                                                                            § 1
1. These Terms of Service specify the conditions of using www.photo2011.eu Internet Service.
2. Each user of www.photo2011.eu Internet service is obliged to acquaint himself/herself with the content of these Terms of Service and the Contest Regulations  available on the Platform, and to comply with them.

                                                                            § 2
Definitions:
Service – the Internet service registered under the domain www.photo2011.eu, which makes the rules governing the contest available and is used to enter the contest “Lens on Development” run for the Ministry of Foreign Affairs of the Republic of Poland;
Administrator – the entity running the Service, which is SF COMPANY Stanisław Fiedor, with its seat in Warsaw, ul. Wąwozowa 6/138, entered into the Business Activity Register with the number 464285;
User – any natural person with full legal capacity, who creates an Account in the Service complying with the conditions of these Terms of Service;
Nickname – a pseudonym, distinctive and unique, chosen by the User and used within the Service, specified when creating an Account in the Service;
Account – an area in the Service, which enables the Users to use the Service, made available for the User after submitting their Nickname and Account password;
Contest – the photography contest run by the Administrator of the Service for the Ministry of Foreign Affairs of the Republic of Poland
Contest work – photo and/or a photo essay submitted by the User to the
Service within the photography Contest.
Terms of Service – the current terms of www.photo2011.eu Internet Service.
Contest Regulations – the regulations of the Contest, made available within the Service, specifying the additional rules and conditions of using the Service.

                                                                            § 3
1. The Administrator of the Service is SF COMPANY Stanisław Fiedor, with its seat in Warsaw, ul. Wąwozowa 6/138, entered into the Business Activity Register with the number 464285.
2. In order to use the Service it is necessary to have: devices and Internet connection which make it possible to access the Internet, email box and web browser (it is recommended to use the following web browsers, with enabled "cookies": Internet Explorer 6.0, Firefox 3.5, Opera 9.0, Google Chrome or the newer versions).
3. Using the Service may require downloading cookies. Cookies are files which are stored on the hard disk of the User’s computer in order to save the User’s website preferences. Cookies are stored in order to keep the User’s session (after logging into the Service) and to make Service statistics. The IP of the User’s computer is used to make statistics
4. Using the Service (including creating and having an Account) is voluntary and gratuitous.

                                                                           § 4
1. Users of the Service may be any natural persons with full legal capacity, who create an Account in the Service consistent with the provisions of these Terms of Service and the provisions of the Contest Regulations available in the Service.
2. In order to create an Account it is necessary to meet the technical requirements specified in §3 point. 2 of the Terms of Service and own an active email box.
3. In order to create an Account in the Service it is necessary to submit the following information in the registration form:
(i) Nickname and password – chosen by the individual creating the Account,
(ii) name and surname,
(iii) email address,
(iv) place of residence,
(v) country of birth,
(vi) date of birth,
(vii)contact telephone number.
4. Every User who creates an Account has access to the personal data submitted by him/her and may verify or modify this information.
5. In the event of a change in the personal data submitted when creating an Account, the User is obliged to updating it.
6. In order to delete an Account, the User should contact the Service Administrator by using the contact form available in the Service. The Service Administrator shall delete the User’s Account immediately after receiving the information about the User’s request.

                                                                            § 5
1. The User’s may submit their Contest Works to the Contest using the Service. In order to submit a Contest Work it is necessary to create an Account.
2. The Administrator reserves the right to verify and approve the submitted Contest Works before publishing them in the Service. The Administrator is authorized to not publish in Service such Contest Works which are inconsistent with the provisions of the Contest Regulations.
3. The User’s are not allowed to submit to the Service such Contest Works which violate the common law or do not meet the Contest Regulations.

                                                                            § 6
The Administrator may block an Account without warning, if he finds the given User has violated the Contest Regulations, especially §5. point 3. The Administrator shall unblock the Account at its own discretion, after the User completes the actions specified by the Administrator as the reason of blocking.

                                                                            § 7
1. The Administrator does not bear responsibility for the activities of any third parties regarding the Contest Works, or any information submitted by the Users, especially for the unauthorized use of a User’s Account by third parties due to faults unrelated to the Service;
2. The Administrator does not bar responsibility for any: errors, omission, stoppage, removal or delay in the activity or transmission, breakdown of the communication connection; theft, damage, unauthorized access to the Contest entries or application forms, amendments made in the Contest entries of application forms.
3. The Administrator does not bear responsibility for any technical problems, problems with the telephone network, computer network, server or supplier, computer equipment, computer software, failure in receiving the email application due to technical problems, overload of the data transmission on the Internet or the website or the combination of any of the issues mentioned above, including breakdowns and damage of the Entrants’ computers or anyone else’s, due to the entrance, loading or downloading of any materials related to the Contest.
4. The contents published in the Service belong to the Administrator or to other persons. It is forbidden to copy or use in any other way the materials contained in the Service, exempting any cases foreseen by law. The trademarks published in the Service shall be legally protected, pursuant to the Act of 30th June 2000 on Industrial Property Law (Dz. U. z 2003 r., Nr 119, poz. 1117 ze zm.) and the provisions of other  legal acts (including international acts), and the Users (as well as any other unauthorized persons) are forbidden to use them in any way.

                                                                            § 8
1. The User may submit complaints to the Administrator regarding any disturbances in the functioning of the Service by using the contact form available in the Service.
2. The Administrator shall examine  by the complaint within 14 days since the day of submission. The complaint should include a detailed description of the disturbance as well as the period of time that it occurred. If necessary, the Administrator shall send his answer to the submitted complaint to the email address specified by the User (or the email address used by the User to submit the complaint).
3. The Administrator is authorized to take any necessary steps to remove the disturbances in the functioning of the Service and to restore the proper functioning of the Service (including User’s Accounts).

                                                                            § 9
1. Any provisions hereof can be at any time amended by the Administrator with no specification of the reasons for the amendments. The amendments shall be published on a current basis with the information confirming that they have been made.
2. After publishing at the Service the information regarding the amendments hereto, the User shall immediately read the amendments, because logging into the User’s Account after the announcement of such amendments shall be equal to the unconditional acceptance of the new contents hereof by the User.


                                                                          § 10
1. The Administrator of the personal data submitted by the Users (pursuant to the Act of 29 August 1997 on the Personal Data Protection) is the Service Administrator. Every User shall be entitled to access their data processed by the entities specified above, to correct the data in question and to demand that the data be no longer processed.
2. Any matters not provided for herein shall be governed by the pertinent provisions of the Polish Civil Code.
3. Any questions and concerns regarding the functioning of the Service, including questions regarding the conditions of using the Service, shall be sent using the contact form available at the Service.
4. The Terms of Service are binding as of the date of their publication on the website www.photo2011.eu.
