Regulations
of the international photography contest „Lens on development”
1 ORGANIZER AND DURATION OF THE CONTEST:
1.1 The organizer of the international photography contest „Lens on development”, hereinafter referred to as the „Contest”, is the Ministry of Foreign Affairs of the Republic of Poland, with its seat at Al. J. Ch. Szucha 23, 00-580 Warsaw, hereinafter referred to as the „Organizer”.
1.2 The Executor, which acts on behalf of the Organizer and performs all activities connected with the completion and organization, is SF COMPANY Stanisław Fiedor with its seat in Warsaw (postcode 02-796) Wąwozowa Street 6/138, e-mail: konkursMSZ@fuero.pl, hereinafter referred to as the „Executor”.
1.3 The contest is managed by the website www.photo2011.e, which is administered by the Executor.
1.4 The works need to be sent in between 3rd October 2011 and 1st November 2011.
1.5 The Organizer reserves the right to change the dates specified in point 1.4 above.
1.6 The Executor shall appoint a Jury, which shall supervise the proper course of the Contest.
2 DEFINITIONS OF THE TERMS USED IN THE REGULATIONS:
2.1 Entrant – an eligible entrant is any natural person who is a citizen of a country within the EU and has all citizen rights and capacity.
2.2 Website – the website www.photo2011.eu is where one registers, submits Contest works, reads the Contest Regulations and at the same time is obliged to full acceptance of its content, website Regulations and of the approved members of the Jury.
2.3 Jury – the Jury is to ensure that the contest runs properly, as well as to mark the contest works and select the prizewinners. The Jury is appointed by the Executor, having the members of the Jury approved by the Organizer beforehand.
2.4 Contest Work – a photo or photo essay, belonging to one of the four Contest categories, submitted to the contest via the Internet site.
2.5 Developing countries – according to the classification of the Organisation for Economic Co-operation and Development (OECD) , developing countries are countries which qualify for the Official Development Assistance (ODA) . The full list of countries – recipients of the ODA - can be found on the OECD’s website.
2.6 Prizewinner – a person who is given an award upon the decision of the Jury.
2.7 Internaut/s – users of the Internet, excluding the Entrants of the Contest.
3 THE AIM AND SUBJECT MATTER OF THE CONTEST:
3.1 The photography Contest is organized within the European Development Days, which are a forum for discussing development cooperation, and is organized by the European Commission and the country currently holding the Council presidency. Following the Polish presidency in the Council of the EU, the European Commission in cooperation with the Ministry of Foreign Affairs of the Republic of Poland, organizes the VI edition of this event on 15th and 16th December 2011.
3.2 The aim of the Contest is to raise awareness among the EU citizens about the problems and challenges of the developing countries. The Contest also aims at broadening social awareness of the Millenium Development Goals and the issue of global development, as well as understanding its complexity.
3.3 The subject matter of the Contest are the development challenges of poor countries and of countries undergoing political transformation. The Works submitted to the Contest should present the daily life, culture and problems of the inhabitants of the developing countries.
3.4 After announcing the results of the Contest, an exhibition of the awarded works shall be held. The exhibition will take place on the territory of Poland between 15th and 29th December 2011.
4 CONTEST WORKS. CONTEST CATEGORIES:
4.1 The Contest is divided into three categories:
4.1.1 Water – the source of life and health
4.1.2 Education and entrepreneurship – the key to a better life
4.1.3 The influence of the natural environment on human life
4.1.4 Photo essay – concerning one of the Contest categories in points 4.1.1-4.1.3
4.2 The Executor reserves the right to move any Contest work to a different category than the one chosen by the Entrant, without consulting the Entrant. It is forbidden to perform any photomontage consisting in using elements of photographs belonging to different files or changing the original composition of the photo.
4.3 The Contest works shall be submitted exclusively by electronic means using the website www.photo2011.eu.
4.4 All works must be saved in JPG format. The files submitted to the Contest should not exceed 2MB, and the longer side of the Contest work should not exceed 2000 pixels.
4.5 Entrants shall keep their original work in digital form which meets the following requirements, and in case of being awarded, the given Entrant might be requested to send it in:
a) format: JPG (lowest compression / best quality);
b) RGB colour standard;
c) definition: min 300 dpi (shorter side no less than 20 cm).
4.6 The submitted works can be black and white or in colour.
4.7 The submitted works cannot have been earlier awarded in any other photography contest.
4.8 Entrants must submit only works created individually and must have full copyright ownership. It is forbidden to submit works belonging to other persons. Entrants bear full responsibility of their submitted works, especially if they violate the rights of third parties. In the event of a third party laying claims concerning the violation of their rights, the Entrant is obliged to meet the claims.
4.9 In the event of violating the law, the rights of any third party, or any attempt of cheating, the Executor reserves the right to remove the given work from the Contest. The Executor does not need to send any statement to the Entrant in order for the action to be valid. The Executor also has the right to remove works from the Contest for other reasons, without informing the Entrant about it. Works with content perceived as vulgar, obscene, offensive, racist, or containing nudity, pornography, eroticism, or offending anyone’s feelings, including religious feelings, displaying violence or calling for violence or related to any kind of discrimination will not take part in the Contest.
5 ENTRANTS:
5.1 The Contest cannot be entered by employees and representatives of the Organizer or the Executive or of any entities involved in the preparation and course of the Contest, as well as members of their families and the closest persons.
5.2 Entrants who do not meet the requirements specified by the Regulations or who submit any false information shall be automatically disqualified.
6 SUBMITTING ENTRIES TO THE CONTEST:
6.1 Works belonging to one of the four categories specified in point 4.1 shall be submitted using the website www.photo2011.eu.
6.2 The usage of the website www.photo2011.eu is subject to these Regulations.
6.3 In order to enter the Contest, the Entrant is obliged to register on the website.
6.3.1 The Entrant is obliged to accept the Regulations of the Contest and of the website, as well as agree to the processing of his/her personal data (‘Data’), submitted by the Entrant in the entrance form, make a statement confirming the Entrant’s citizenship of one of the EU countries, as well as a statement confirming the Entrant’s full public rights and legal capacity.
6.3.2 The Entrant shall submit in the regoistration form his/her name and surname, address, country of birth, telephone number, date of birth, email address, which will enable the Organizer and the Executor to contact the Entrant about issues related to the Contest, an anonymous ‘nickname’, as well as a password, which combined with the email address will enable logging into the website www.photo2011.eu and using it.
6.3.3 One can register on the website only once. Deliberate multiple registrations into the service performed by the same person shall result in removing these accounts and the respective works, as well as disqualifying the individual from the Contest.
6.3.4 By submitting to the Contest, the Entrant agrees that his/her ‘nickname’ may be placed on the ranking lists and/or used in another way related to the organization and course of the Contest.
6.3.5 The Entrant bears full responsibility for the consequences of sharing his/her password with third parties or storing the password insecurely.
6.4 The submitted works shall not be automatically displayed on the website.
6.5 The works submitted to the Contest shall be displayed on the website for the internauts to vote within one day after the date fixed for submitting the works.
6.6 The submission of entries to the Contest shall take place from 3rd October to 1st November 2011 – the date of sending the works shall be decisive, after closing the registration on the website.
6.7 Each Entrant may send up to 3 works to every category specified in point 4.1 with reservation of point 6.8. Each Entrant may altogether submit no more than 10 works, in all categories.
6.8 In the category ‘Photo essay’ – Entrants may submit only one work related to the issues of the developing countries within the categories specified in points 4.1.1-4.1.3, and the work should consist of minimum 3 and maximum 6 photos.
6.9 Each work must have a title, photo description (at least 75 marks, only in English or Polish language version), the place and date of making the work.
6.10 The Organizer and Executor do not bear responsibility for incorrect data submitted at the registration, especially for the change of personal data and/or email addresses, which makes finding the Entrant and/or awarding him/her impossible.
6.11 The Organizer and Executor do not bear responsibility for errors in the registration process resulting from improperly working Internet connections or Entrant’s systems, as well as any other circumstances independent of the Organizer and the Executor which make entrance in the Contest and/or meeting all the requirement of the Regulation impossible.
6.12 In the event of an Entrant taking any action conflicting with the Regulations, or any action which is against the law or good manners, aiming at winning the Contest, the Organizer reserves the right to verify the votes and the results, and exclude the Entrant from the Contest. In the event of the Entrant being excluded from the Contest, the Entrant is obliged to return the awarded prize. Returning the prize does not exclude the Organizer’s right to claim compensation from the Entrant on general terms.
7 COPYRIGHT:
7.1 By entering the Contest on the terms specified in the Regulations, each Entrant of the Contest states that he/she owns full copyright to the submitted works and that all the persons displayed in the photo have agreed to their public exposition.
7.2 When awarded a prize in the Contest, the Entrant agrees to:
7.2.1 multiple, gratuitous publication of the awarded works (with sublicense rights), with no territorial limits, as well publicising his/her name, surname, place of residence in promotional materials related to the Contest and the photography exhibition presented at the European Development Days, on websites www.photo2011.eu, www.msz.gov.pl, www.polskapomoc.gov.pl, www.eudevdays.eu, www.ec.europa.eu, as well as in publishing houses, promotional and informational materials, as well as other materials and documents related to the activity of the Organizer or any entities cooperating with him.
7.2.2 using Contest works for promotional and marketing means of the Organizer, especially to the preservation and multiplication of the Contest works by all kinds of techniques, e.g. printing, reprographic, magnetic storage, digital, audiovisual on any carriers, with no quantitative and qualitative limits, as well as publicizing the works in public displays, allowing every person to have access to the work at any time and place, especially in computer networks, Internet and on TV.
7.3 The transfer of property rights shall take place immediately after the announcement of the results of the Contest, by each prizewinner signing an agreement concerning the transfer of property rights, which constitutes the attachment nr 1 to the present Regulations. The prizewinner is not entitled to any other reward for transferring the property rights, besides the Prize.
7.4 The Organizer reserves the right to sign an agreement concerning the transfer of property rights with Entrants whose works were not awarded by the Jury, but are considered valuable by the Organizer.
7.5 To all matters not settled herein provisions of the Act of 4th February 1994, copyright and related rights (Dz.U. z 2006 r. Nr 90 poz. 631 z późn. zm.) as well as the provisions of the Civil Code shall apply.
8 EVALUATION OF THE CONTEST WORKS:
8.1 The Contest works shall be evaluated by the Jury by debates and voting, after the date fixed for submitting entries.
8.2 The Jury shall evaluate the Contest works in all four categories of the Contest and will take into consideration:
8.2.1 the work’s relevance to the theme,
8.2.2 the work’s artistic value,
8.2.3 tthe work’s technical value,
8.2.4 the originality in approaching the theme.
8.3 Internauts shall vote for the best Contest works in all four categories during the 14 days following the date fixed for submitting works.
8.4 Each internaut may give only one vote to each work.
8.5 The number of votes given to each work shall be presented on the day of announcing the Contest results. The persons whose work received the biggest number of internaut votes in the given category shall be awarded.
8.6 Prizewinners shall be informed by the Executor about the Jury’s and internauts’ decision via electronic and post mail.
8.7 The prizewinners, when informed about having received an award, may be requested to send to the Executor’s email address specified in point 1.2 digital files fulfilling the technical parameters specified in point 4.6 with the awarded work, if the photo does not meet the editorial requirements.
8.8 Not sending the digital file of the awarded work within three days after being informed via electronic mail results in the work’s disqualification.
8.9 The Jury’s decisions are final and binding for all Entrants of the Contest.
8.10 The Organizer and the Executor shall inform about the results of the Contest on the websites stronach www.photo2011.eu, www.msz.gov.pl, www.polskapomoc.gov.pl www.eudevdays.eu and www.ec.europa.eu using the prizewinners’ names and surnames, which the Entrants agree to when entering the Contest.
8.11 Contest Works considered by the Organizer as incoherent with the contest topic, described in point 3 of these regulations, will not participate in the Jury or Internauts voting.
9 PRIZES:
9.1 The prizewinners shall be awarded by the Organizer the following prizes:
a) Grand Prix of the Contest of 2 500 EUR gross value;
b) I prize in each of the 4 categories of 1 000 EUR gross value;
c) II prize in each of the 4 categories of 500 EUR Gross value;
d) Internauts’ prize in each of the 4 categories of 400 EUR gross value.
9.2 The prizes shall be paid in Polish Zlotys (PLN), after converting the sum from the average EURO rate of the National Bank of Poland (NBP) on the day preceding the contest’s announcement.
9.3 The Jury reserves the right to a different prize distribution, as well as not giving any award in the chosen category.
9.4 The awards shall be given on 15th December and the prize-winning works will be formally presented on this day in the Copernicus Science Center in Warsaw during the European Days of Development.
9.5 The prizewinner of the Grand Prix Contest and the I prizewinners of the four Contest categories shall be invited to the Ceremony in Warsaw.
9.6 The costs of transportation and accommodation in Warsaw of the five prizewinners shall be covered by the Executor, who will also manage all the reservations.
9.7 Prior to the award distribution, the prizewinners are obliged to make an official statement about fulfilling the requirements specified in point 5.1 within 14 days following the announcement of the results.
9.8 The right to receive the awards cannot be transferred to a third party.
9.9 In the event of a prizewinner not fulfilling the requirements specified in these Regulations, his/her award shall be canceled.
9.10 In accordance with art. 30 item 1 point 2 of the Personal Income Tax Act of 26th July 1991 (Dz. U. z 2000 r. Nr 14, poz. 176, z późn. zm.) in the event of having income from a prize awarded in a contest in the area of culture and art, in which the one-off sum exceeds 760zl, the Prizewinner is obliged to pay a lump-sum income tax of 10% of the prize’s value.
10 LIMITED LIABILITY:
10.1 Entrance in the Contest is tantamount to the Entrants’ permission to exempt the Organizer, his partners, employees and representatives from the responsibility to any claims, losses and compensation which may arise from entering the Contest or any activities related to the Contest, including receiving, using or improperly using or keeping the prize awarded in the Contest.
10.2 The Organizer and Executor do not bear responsibility for any: errors, omission, stoppage, removal or delay in the activity or transmission, breakdown of the communication connection; theft, damage, unauthorized access to the Contest entries or application forms, amendments made in the Contest entries of application forms. The Organizer and Executor do not bear responsibility for any technical problems, problems with the telephone network, computer network, server or supplier, computer equipment, computer software, failure in receiving the email application due to technical problems, overload of the data transmission on the Internet or the website or the combination of any of the issues mentioned above, including breakdowns and damage of the Entrants’ computers or anyone else’s, due to the entrance, loading or downloading of any materials related to the Contest.
11 FINAL PROVISIONS:
11.1 The Contest’s regulations can be accessed at the seat of the Organizer, and on the websites www.photo2011.eu and www.polskapomoc.gov.pl.
11.2 The Organizer reserves the right to change the Regulations at any time, as long as it does not make the conditions of entering the Contest worse.
11.3 Persons who do not fulfill the requirements specified in the Regulations or submit any false information shall be automatically disqualified.
11.4 Any matters not provided for herein shall be governed by the pertinent provisions of the Polish Civil Code.
11.5 The Contest is not a game of chance in means of the Act of 29th July 1992 on games of chance and mutual betting (Dz. U. Nr 68, poz. 341, z późn. zm.).
11.6 The admission to the Contest and making the website available for public display of the Contest works are the only benefits of the Organizer or, respectively, the Executor, performed for the Entrants regarding the license for using the Contest works, specified in point 7. The Entrants are not entitled to any remuneration.
11.7 The Entrants’ personal data submitted to the Contest shall be processed by the Executor in order to fulfill his duties related to the Contest, for marketing means. The data shall be protected in accordance with the Personal Data Protection Act (DZ. U. Nr 133/97, poz. 883). The Entrants have the right to access the content of their personal data and to their correction, in order to do so they should contact the Executor, who is the administrator of the data in meaning of the Personal Data Protection Act (Dz. z 1997 r., Nr 133, poz. 883). The submission of one’s personal data is voluntary, but necessary for entering the Contest.
11.8 The Organizer and Executor shall not return the submitted works.
11.9 The Regulations are effective as of the date of announcing the Contest.
11.10 Submitting an entry via the website www.photo2011.eu is tantamount to the Entrant’s acceptance of the terms specified in the Contest’s Regulations.
